Criminal Records Checks Vancouver Coastal Health - Decision Issued

Late last year, the grievances over who is required to pay for new criminal record checks mandated by legislation were heard by an arbitrator.

After hearing submissions from the union and the employer, the arbitrator determined that employees are required to pay because the union had tried to negotiate that both employer and legislation required checks would be paid for by the employer in 1998, but was only successful in negotiating that employer required checks would be paid. No further changes to the language were negotiated since that time.

As such, there is no collective agreement requirement for the employer to pay for these checks. Therefore, health care employees are required to pay the $20 for checks required by the Criminal Records Review Act.
